Brown Asks State Supreme Court To Speed Up Pension Cases Without Filling Key Vacancy

Gov. Jerry Brown has asked the California Supreme Court to speed up review of a lawsuit challenging the 2013 Public Employee Pension Reform Act.

One wrinkle: Brown is delaying his decision to fill the seat of retired Justice Kathryn Werdegar, who announced her departure in March 2017. If Brown waits until late August to fill the seat, the new justice would be up for election in 2022 instead of 2018.

Attorney David Ettinger is an appellate specialist who blogs about the California Supreme Court for At The Lectern: Practicing Before the California Supreme Court. He joins Insight to discuss the tension between the high court and the governor over the lengthy vacancy.
