The Sacramento Sheriffs Department has arrested Nicory Marquis Spann for attacking and shooting one of its deputies at a Regional Transit stop Tuesday night.
Spann has a lengthy criminal history, including involvement in a double homicide in Mountain View in 2008. According to Santa Clara County Superior Court documents, he was originally charged, along with four others, with murder and conspiracy, but eventually pleaded guilty to receiving stolen property and accessory after the fact.
He is also the subject of a current application for a restraining order by a family in Galt.
One man, who requested he not be identified, says Spann "tried to lift up my (niece's) shirt" as she was walking home in late May.
The man says Spann had also been seen by neighbors peeking through the window of the family home and had been seen following groups of elementary school children leaving the school in the Galt neighborhood where they live.
The man says he found Spann three days after the girls allegation of the harassment, "My (niece) gave a very good description: brown leather jacket, plaid shirt."
The man says when he asked Spann about the allegation, Spann punched him in the face and ran.
The man tracked Spann down and called police.
Spann pleaded no contest to battery.
According to court documents filed in Sacramento County Superior Court, Spann has faced about a dozen charges in the last five years, including disturbing the peace, destruction of property, brandishing a weapon, threatening to commit great bodily injury, resisting arrest, and battery.
He pleaded no contest to battery, destruction of property, and resisting, delaying, or obstructing a police officer or emergency medical technician.
Spann is due in court Friday for both the restraining order and attempted murder of Sheriff's Deputy Alex Ladwig.
The department says Ladwig told investigators Spann attacked him, took his gun and fired twice, hitting Ladwig once in the face.
Ladwig is in stable condition at a local hospital.
The man says he hopes Spann stays in jail this time, "Hopefully they get him in jail for something because they only got him for two weeks for assaulting me."
