(AP) - A federal appeals court in California will consider Monday whether long and unpredictable delays in carrying out executions in the state amount to cruel and unusual punishment.
U.S. District Judge Cormac Carney had ruled in the case of a Los Angeles rapist and murderer that the state's death penalty was dysfunctional and that very few of those sentenced to death will actually be executed before dying of natural causes.
But Attorney General Kamala Harris appealed the ruling.
