The Campaign for California Families has filed suit in the Court of Appeal to stop county clerks from issuing marriage licenses to same sex couples. Randy Thomasson leads the organization.
He says the high court did not have the authority to make its ruling last month that allowed for same sex marriages. He says that’s up to the legislature or the voters. He says the ruling also raises questions about marriage– including whether polygamy would be allowed.
“The court of appeal should restore sanity to this legal quandary that has been created by the state Supreme Court…”
Shannon Minter who is the Legal Director for the National Center for Lesbian Rights calls the appeal improper. He says the lower courts have no discretion over a high court decision.
