Julie Regan with the Tahoe Regional Planning Agency says their staff discovered last summer that John Fitzhenry poisoned three Jeffrey pines on his $2.4 million property on the north shore.

"Interestingly enough, the property owner applied for a tree removal permit for different trees on the property so while we were on sight we discovered that the property owner had actually drilled holes in the trees and tried to poison them."

Fitzhenry apologized to agency members, saying the act was the most foolish thing he's ever done.

TRPA staff originally proposed a $17,000 fine but environmentalists said that amount wasn’t enough of a deterrence.
