Superior Court Judge Judy Hersher’s ruling invalidates an emergency order issued late last year by Governor Schwarzenegger that blocked the January first implementation of the one-to-five ratio.
Outside the Sacramento County courthouse, California Nurses Association Executive Director Rose Ann DeMoro said the 1999 law will now be enforced.
The state estimates that up to 34 hundred new nurses must be hired to meet the new guidelines. The Schwarzenegger administration and the California Hospital Association had argued that a nursing shortage in the state, coupled with the requirement to hire new nurses, could drive some hospitals into bankruptcy. The administration and the Hospital Association are expected to appeal.
